GRSV Posted January 23, 2020 Report Share Posted January 23, 2020 Hi, I have got my H1B approved in Oct 2017 through consular process so I just got an approved I-797B. Due to some reasons I neither moved to H1 status nor activated my H1 and I have always been on H4 status. Yesterday, I received an e-mail from USCIS stating their intent to revoke my approved H1. My question is: After my H1 is revoked, if I wish to change to H1 status in future will it be a cap exempt or do I need to get it done as a fresh H1(going through lottery)? Quote Link to comment

I read this from one of the forums: “IF H1b has been picked in the lottery in the last 6 years (regardless of approved or revoked), the petitioner wont be subject to the lottery again.“ Isn’t this information correct?
