Das Pakanati Posted January 22, 2020 Report Share Posted January 22, 2020 i797 expired on 09/04/2019 and i-94 expired on 09/14/2019 Applied for extension on 09/03/2019 and its got Denied on 12/23/2019 but received physical notice on 01/01/2020. Reopened on 01/21/2020 through motion to reopen option. Applied new petition on 01/10/2020 So there is gap from 12/23/2019(01/01/2020 Denel ) to 01/10/2020 , around 18 days overstay. Can I stay in US with new petition? Can I work on when opened my Dined petition through the MTR? From when we need to consider overstay, either online status date or physically received data of Denial Notice? Thanks, Das Quote Link to comment

Check with your attorney about these 2 questions: What will happen if the MTR is denied?
