paulga Posted January 19, 2020 Report Share Posted January 19, 2020 Hi I am currently working in the US under H1b visa status, now the status is reaching its 6 years cap. My previous employer filed PERM and I-140 for me. I-140 was approved in 2016. If my H1b reaches 6 years, and priority date becomes current, am I still eligible to extend H1b beyond 6 years? paulga Posted January 25, 2020 Author Report Share Posted January 25, 2020 so H1b can still be extended year by year after PD becomes current (and I-485 not filed)? previously more than one attorney told me h1b is no longer eligible for extension if (1) PD goes current and (2) AOS (I-485) is not filed.
