General Question on 485

Hello,

Background: My I-140 which was filed by previous employer is approved and my green card priority date has become current. Previous employer has not revoked I-140 and it is active.  Currently i am in India and my H1 is expired.

My Question is: Since I 140 is approved and green card priority date has become current can i file 485 my self or through some attorney and get green card? Please help answer this question. Thanks.

AOS cannot be done from outside the country. Secondly does the GC sponsor not want you back? Is that job not available?

You will have to start the whole process from PERM, then I-140 and file for Green card with new employer. You can make request to use same Priority date. Also if you remain out of US at the time of applying for Green Card (third step) you will have to file using Counselor processing rather than Adjustment of Status.
