Previous employer has not revoked I-140 and it is active. Currently i am in India and my H1 is expired. My Question is: Since I 140 is approved and green card priority date has become current can i file 485 my self or through some attorney and get green card? Please help answer this question. Thanks. care_candidate Posted January 17, 2020 Report Share Posted January 17, 2020 You will have to start the whole process from PERM, then I-140 and file for Green card with new employer. You can make request to use same Priority date. Also if you remain out of US at the time of applying for Green Card (third step) you will have to file using Counselor processing rather than Adjustment of Status. Quote Link to comment
