ATK Posted January 17, 2020 Report Share Posted January 17, 2020 HI, I have stayed in US for 3 years in L1B petition. My first L1B extension got rejected and moved out from US last Sep-2019. I am looking to apply fresh H1 for this year. Do USICS has any policy for cool off period to wait for a year or 6 months to apply? Please provide your inputs. JoeF Posted January 17, 2020 Report Share Posted January 17, 2020 Since it has been less than a year when you left the time on L1 and H1 would be combined, i.e.g., your max. time on H1 would be 3 years. To get the full 6 years on H1 you would have to be abroad for at least a year before the H1 is filed. Quote Link to comment
