kumarsen Posted January 16, 2020 Report Share Posted January 16, 2020 Hi, I joined company B from A and when I joined company B the project I was selected started resource ramp down. So I couldn't join that project. So my company B started amendment for another location. So all that process took 50 days till I receive LCA for the new location. Till then I was waiting on bench and didnt do any work and was waiting for that LCA in comapany B. Is it legal to wait on bench without any work for 50 days when we wait for amendment?. gopalakrishnach Posted January 17, 2020 Report Share Posted January 17, 2020 In H1B, there is no concept of bench. Your employer must pay you evethough you are not any project. If you do not have any pay and no payroll was run then you need to justify. Quote Link to comment
