dream09
Hello All, I got 221(g) during my visa interview and the VO informed me my case was under Administrative Processing. After 4 months my visa was denied and got a Refusal letter in the email. What options do I have now? 1. Will the USCIS contact the petitioner / employer for more evidence? 2. How long does it usually take to process these types of cases? 3. Would I be able to transfer my H!B at this point to a different employer? Any help on this is much appreciated. Thanks. User099
3. If you were ever in US on a H1 visa, you will be able to transfer to a different employer. Quote Link to comment
gopalakrishnach
1. Will the USCIS contact the petitioner / employer for more evidence? --- once 221G decision resulted in denial they will not contact for more evidence on your case. If they want to checkout about your employer they ask unrelated to your case. 2. How long does it usually take to process these types of cases? -- your case is already denied. What case you talking about.. 3. Would I be able to transfer my H!B at this point to a different employer? your 221G resulted visa denial so H1B is gone. I am not sure you have anything to transfer. But I feel you can apply new H1B outside lottery. I maybe wrong.. Quote Link to comment
