krish2788 0 Report post Posted January 11, 2020 My H1B visa is going to expire in March 2020 which is also maxing out at the same time. Due to this I am planing to go India by end of Jan 2020. I would like to know, if My employer file extension from India after 1 year of cooling period under exempt, would this reset my H1B 6 year clock? Has anyone gone through same kind of situation? JoeF 7 Report post Posted January 13, 2020 After 1 year abroad, you can either get the remainder of the H1 if there is any without going through the quota, or you can get a new 6 years by going through the quota. Share this post Link to post
User099 0 Report post Posted January 14, 2020 Just staying outside doesn't reset your clock, you will have to go thought the lottery again to get a fresh 6 years after staying outside for 1 year. Share this post Link to post
giri26 0 Report post Posted January 14, 2020 No extending your current H1 will only give you reminder of the H1B time you have left now. If you want to get a fresh 6 year term, you would need to go through the lottery for H1B filed at least after a year of absence from US. Share this post Link to post
