But my I-539 for Change of status is not yet approved with only finger printing done. I have a valid H4 visa from my husband's previous employer. I need to travel to India in last week of Jan 2020. Since my I-539 is not approved, can I show my husband's I-79 petition and my valid visa documents when returning at the US port of entry ? Or is it necessary to go for a visa interview again ? Please advise. If you have a valid visa, you can show your husband's latest I-797 petition at port of entry and enter US. No need of new stamping. Just make sure to check your online I-94 after entering US to make sure H-4 expiry I-94 date matches with your husband's I-797 expiry. Quote Link to comment
