Tpnaik
Hi there, Here is my situation, any guidance would be greatly appreciated. 1. I lost my job today due to a lay off 2. I was working on H1B extension receipt (H1B/I94 expired on 12/31/2019) Employer may revoke the petition soon due to termination 3. I have an approved I- 140 (EB1C) 3. Spouse's H1B extension is in progress (expired on 12/31/2019). She is currently working on visa receipt Wondering what are the options that I have to legally stay in US. Per my understanding I am out of status since the employment is terminated and the 194 was expired few days ago. Can I immediately file the H4 COS petition using my wife's visa and continue in US until I get another job? Or do I need to leave the country immediately? Quote Link to comment
User099
You will need to leave the country and apply for a H4 visa after your spouse's H1 petition is approved. Quote Link to comment
gopalakrishnach
I-94 was expired few days ago -- I feel leave ASAP. I may be wrong... Apply for H4 using wife's H1BASAP. Quote Link to comment
