_Sia Posted December 30, 2019 Report Share Posted December 30, 2019 My current visa situation, any help will be appreciated: 1)Was in the US till Jan 2019 on H1B(Employer-Infosys Ltd.) 2)Days left on H1B~20 out of the 6 years.3)i140 approved in April 2019.4)H1B out of cap extension applied in premium processing in August 2019 and denied by USCIS.5)Travelled to US on H4 visa in Nov 2019.6)Currently on H4 visa with H4 extension and H4EAD applied 2 weeks back(Spouse’s H1 extension is approved). All applications were applied together.In this above scenario:1)Can another employer file for an out of cap H1B petition for me based on an approved i140 which was filed by Infosys Ltd.2)Can a new H1B petition be filed for me in coming April 2020 cycle? User099 Posted December 30, 2019 Report Share Posted December 30, 2019 1. Yes, any employer can file for a cap exempt petition for you on basis of I140 if it was approved for more than 180 days. 2. Why do you need a new petition when you are able to qualify for EAD and cap exempt H1. Your new employer can also start your Perm and I140 while working on EAD. Quote Link to comment
