H1B nearly 7 years, I-140 approved 3.5 years, never been on cap visa

I have been on a cap-exempt H-1B for nearly 7 years, have a I-140 approved for 3.5 years, have never been under the cap and am currently on extension (due to approved I-140). If I want to take up a new job in the private sector, do I need to come back under the cap? Or am I cap-exempt now, regardless of where I get an offer?

The employer would have to file in the quota.
