After I-140 approved, adding spouse

Hello,

My employer applied green card for me and during that time my husband’s green card was on process from another marriage. My husbands I-140 is approved and he went to interview. While waiting interview result, we’ve learned that his i-140 will be rejected since he got remarried before I-140 is approved. I did not file him to my case since his was going on meanwhile. But now it got rejected and mine already got approved, can I still add him? Will this affect my case negatively? We were not told by lawyer that he cannot get remarried before I-140 approval so do we have any right on that?

An I-140 would not get denied because a spouse wasn't mentioned. Things happen in the years between filing and adjudication. His rejection had another reason
