Lawseeker13
Hello, My employer applied green card for me and during that time my husband’s green card was on process from another marriage. My husbands I-140 is approved and he went to interview. While waiting interview result, we’ve learned that his i-140 will be rejected since he got remarried before I-140 is approved. I did not file him to my case since his was going on meanwhile. But now it got rejected and mine already got approved, can I still add him? Will this affect my case negatively? We were not told by lawyer that he cannot get remarried before I-140 approval so do we have any right on that? Edited December 12, 2019 by Lawseeker13 Quote Link to comment
JoeF
An I-140 would not get denied because a spouse wasn't mentioned. Things happen in the years between filing and adjudication. His rejection had another reason Edited December 12, 2019 by JoeF Quote Link to comment
pontevecchio
This is the way it works. Once your PD is current, he can apply for AOS along with you. Quote Link to comment
