H4 h4 ead filling

Hello All,

my husband is on h1b and had dismissed shoplifting case. We got certified disposition from court. I’m on dependent h4 visa. I want file for my h4 & h4 ead visa. There is an question in h4 extension application as follows:

Have you or any other person, included in this application, ever been arrested or convicted of any criminal offense in the United States?

1)what should I answer yes / no as case is dismissed without conviction?

2)What are my chances to get h4 visa approved?

How the case was dismissed either by class or under probation??
