Approved i140 by employer A , successor in interest petition pending by employer A-1, switch to employer B

Hey ,

I have an approved i140 petition approved by employer A. My company got acquired and employer A-1 has filed for a successor in interest petition . I have job offer from employee B . Would there be any issues if I switch employers when this successor in interest petition is pending ?

Thank you for the reply. Can you clarify if there would be issues In the below scenario ?

 

1. Employer B applies for h1b transfer
2. employer A1 successor in interest petition gets approved
3. I switch employers 
4. Employer A1 withdraws petition

can I port my Priority date when employer B applies for my green card?

You can port your Priority date if I140 has been pending for more than 180 days.

I don't see any issues with your scenario, but for a deeper dive you will have to give your I94 dates.
