F2 to h4 with 2 misdemeanor

I am currently on f2 and i was arrested for 2 misdemeanors in the same situation and case was dismissed. 

My husband's h1 approved yesterday.

1.Is it better to just quit, leave for India, fill up DS160 and get H4 stamp done instead of going via H4 COS route?

2.what are the chances of approval of getting h4 visa stamp if i move us?

3.is it better to wait in usa until my cos approval and then go to my home country for stamping?

My husband's employer doesn't know about my arrest.

Please advise. Whether  prefer to stay in US until h4 cos to go for stamping or to leave country for now stamping.

You should discuss your matter with an Immigration lawyer.

It won't make difference as long as your cases were dismissed. You should expect up to 8 weeks of delay to get the passports back after the interview

Now or later, you should take that call as per your convenience keeping delay in mind
