Adat
My Parents are currently in US and will be leaving back to India 2 days after i become US Citizen. Should I apply for I-130, I-485 and AP before they leave (after i become US Citizen)? or Should I just apply for I-130 and deal with the rest while they are in India? Quote Link to comment
pontevecchio
Assuming they are interested, the way to go is by filing an I-130 for both and continue via consular processing. Quote Link to comment
Adat
Can they still visit US on their visitor visa while their consular processing is in progress? or Do they have to refrain from visiting US on their visitor visa until their immigration visa is obtained? Quote Link to comment
pontevecchio
Assuming you are on the ball and all relevant documents are available, the time frame is 1 year and they should be able to stay away for that time. If the great dictator is vanquished, then a hypothetical trip after that on the tourist visa is thinkable. Ideally they should be patient. Quote Link to comment
JoeF
The I-130 shows immigration intent, which is not allowed for visitors. The likelihood of getting denied entry if they travel on a visitor visa is very high. Quote Link to comment
