I140 - 180 day rule

Hello Everyone,

My I140 was approved and i had quit my employer prior to 180 days. I did get a extension of my H1 for 3 years under my new employer and i'm getting a full time offer with my Client. My previous employer has still not withdrawn my I140 and its been more than year now. So my question will i loose my I140 in case my previous employer decides to withdraw the I140 application or will i140 still be valid since the approval has crossed more than 180 days.

Even if your employer withdraws your I140 after 180 days, you can still use it for future extensions and maintain the PD.

In most of the cases, the employers won't revoke it. They will simply forget. One of the reasons is that you may return in the future.

However, you have to redo the process from scratch with the new employer to get a fresh I-140 which maybe 1-2 years process.
