lopabeh
i'm in comp A now. my transfer to B is approved while the transfer to another comp C is in process. can I join B and wait for the transfer to C is approved. when the transfer to C is approved, can I join the comp C directly without doing any other paperwork ? what's the best way to join C from B ? can I go out of the country and get stamping done for company C and enter to USA with H1B stamped for comp C ? please advise. pontevecchio
Nothing actually gets transferred. As long as you are in valid H1 status, multiple employers can file an H1 petition before the current I94 expires and you can join whichever you prefer. Quote Link to comment
lopabeh
Just want to make sure - so I can join C from B, without doing any other transfer from B to C ? i was thinking since the transfer was filed from A to C, it may not be valid, if I join C after joining B. Thanks! Quote Link to comment
pontevecchio
Nothing gets transferred. A "transfer" is merely a new employer filing and getting a noncap H1 petition approved. You can join any company with an approved H1 petition for you with an I94. Quote Link to comment
