H1B stamping with sister companies

Hi,

I am currently working for Company A on OPT, so my payrolls are run by them. My H1B was sponsored by Company B and has got approved with Consular processing. (Company A and Company B are sister companies).  When I go for my H1B stamping my last paystubs will be from Company A. Will this cause problems? Any thoughts/suggestion will be very helpful. Thank you in advance!!

I may be wrong but from te date of your H1B starts your payroll must be on Company B since they gt your H1B approved and say that you work for Company B.

Thank you for taking out time and responding to the post @gopalakrishnach!!   yes.. if i think it that way, it sounds right.  One of my concern is, if i get questioned, How long have you been working for this employer and then I am asked for my paystubs , since the company name would differ, how important is that I need to carry the supporting document that Company A and Company B are sister companies.  If not having this supporting documentation, would it be detrimental to my case.

While on OPT you worked for Company A and not Company B. Company A and Company B maybe related or may not be, its not something you should be worrying about.

Company B should provide you enough evidence that the job they offered you exists and is valid. Talk to the attorney who worked on your case and they might help you prepare for the interview.

But if you go with the story that Company A and B are "sister companies" and you will continue to work for A and B will hold H1 will not fly.

hi,

when do you plan on attending for your visa interview? do you atleast 1 paystub from company B ( who sponsored your h1 ?). that should be enough. you can carry your past paystubs from company A and show them as supporting documents if needed.

How can he start working for Company B when the case is Consular processing?

In DS160 I have provided Company A (my OPT employer) under Present Work/Education/Training Information, and Temporary Work Visa Information,   where do you intend to work? I have provided Company B (who is my H1B petioner). This is correct for my case right?   Thank you again for all your help guys...

Yes, this is correct.
