Does my new employer need to file for GC within a specific timeline ( i140 approved)

Recommended Posts

hi,

i changed job with an approved i140 from  previous employer( Company A) in April 2018.

When changing jobs i got an extension on H1B for 3 years for my new employer ( Company B)

In order to retain my priority date and future extensions based on i140 approval, does my new employer( B) need to start the GC process within a certain time from my time of joining them - as far as i know, Company A has not revoked the GC they had filed for.

But in either case, how much time do i have before company B needs to file for my GC.

Also, can i switch employer now ( new company C) and get another H1B extension for 3 years based on approved i140 from company A?

There is no specific time limit. If your I140 from Company A is valid for more than 180 days, it can be used by you to get your future extensions.

I cant tell if you will get 3 years, but you can use your I140 and ask USCIS for 3 years. Now a days extensions are based on how long you have a project.
