sharath Gunturu
Hello, I am working for an Employer A and my job has been terminated on 23rd Aug 2019, My employer hasn't revoked the H1 B yet. Is my grace period for out of status already started? if Yes, My grace period of 60 days will end on 23rd Oct 2019, But I have Job offer in my hand, which takes 2 more weeks (LCA+ H1 submission) to get the receipt Number, what is my case situation if I don't receive my receipt number before 23 Oct 2019. Thanks, Sharath Gunturu Quote Link to comment
gopalakrishnach
It started on 23rd Aug I guess. Without reciept after 23 Oct you will cannot work since you do not have any pending or approved H1B. If your I94 is valid you can stay in USA but cannot work. Once you get receipt number you can work. This is not any legal advice. This is just my personal opinion. Quote Link to comment
JoeF
It is 60 days, which is less than 2 months. The 60 days expire on Oct. 22, not 23. If you don't have the receipt on Oct. 22 your H1 will likely not be approved as EOS. You may ha e to leave the country. Quote Link to comment

In such cases where H1B is denied and I94 is still valid can the person stay in USA but not work and get H1B approved before 240 days and after 60 days let say they approved on 71st day?
