menatasha Posted September 28, 2019 Report Share Posted September 28, 2019 I'm employed in US on H4 EAD, valid till Oct 11 2019. I-94 valid till Oct 20 2019. My employer is filing H1B, with processing type of my choice: Consular or Change of status. I have already applied for my H4 EAD extension in July 2019 but with present situation it is taking ~5months to get first the H4 extension & then EAD extension with the card. To avoid any break at work, my employer is filing H1B under premium processing. Consular or Change of status what is the best & safest to opt for to avoid RFE or denial? Quote Link to comment
User099 Posted October 1, 2019 Report Share Posted October 1, 2019 RFE or Denial will not depend on which option you select, Consular or Change of Status. If you do Consular, you will have to travel to get your visa stamped after approval. Quote Link to comment
