baalu
I have changed my employer in 2015 and the new employer has filed H1 Transfer as well as the PERM/I140. I have received new I140 but the priority date is set to 2016 when it was approved. During the H1 transfer process, the previous employer has withdrawn their 140, which had a priority date of 2013. And, yes, it was revoked after 180 days and the current status on USCIS website shows as "Revocation Notice was Sent" So, my question here is, is it possible to retain the previous priority date of 2013 or did i lost the chance for good? If anyone has faced similar situation, please let me know. Thanks in advance. -Baalu Quote Link to comment
rohit369
Just talk to your current company attorney and explain the situation. It may be a mistake on their end too while filing. Edited November 1, 2019 by rohit369 Quote Link to comment
JoeF
This may have been before the rule that allows to keep the PD after 180 days came into effect. Check with the lawyer. Quote Link to comment
