I had to come to india for stamping because I received one yea H1b extension without I94 as my Employer A did not file for amendement when the project was changed within 25 miles. I got 221 g at stamping in delhi consulate. My case was pending from january , consulate sent my case back to USCIS as my client terminated the contract. Since I have no hopes on this petition, I have joined Employer B in india and they are willing to file new H1b for me. My question is if my Employer A withdraw my I140 which was approved in 2015, can Employer B still file h1b transfer and extension upon withdrawn I140. Please help me as I m getting mixed information.
