Alister Ernest Posted September 16, 2019 Report Share Posted September 16, 2019 Hello, I am employed as a full time Tech Lead at my company, I currently do not have any direct reports and my H1B was filed for that role. It was approved in regular processing without any issues. There have been talks about a promotion for me into the role of a Manager, which will involve direct reports and some of the same work that I have been doing in the past. Based on this scenario, I have a couple of questions: 1. Is a H1B amendment necessary? 2. If the amendment it necessary, what happens in case of the Amendment being denied - can I still resume work in my old role? Or does this mean that my H1B is denied and that I am out of status?
