H4 Receipt not yet received

Hi,

My husband is currently on h1b status which is ending on sep 15th. So his employer filed a h1b extension for him and also filed h4 extension for me and my son in July. Me and my husband got our receipt notices and i even got my biometric appointment. But we haven’t received the receipt notice for our son yet. My husband contacted uscis customer care and they have taken the complaint but we havent heard back from them yet. 

My concern is since the current h1b for my husband ends on sep 15th, If we don’t receive the receipt number within that, will our son be considered out of status? My husband asked the same question to uscis customer care and they said that he should be fine since it is applied. But its still concerning since the cheque that was sent for our son is not yet encashed. Can you please let us know if our son will be considered legally in status though we haven’t received the receipt number?

He will not be considered out of status since you have shipped your documents well ahead of time. Make sure you have the fedex receipt number with you. Try calling USCIS once again explaining the situation.
