I have now moved to a new company in India and i dont have a valid H1B now. Based on my I140, would it be possible for me to aplly for Non Cap H1B? Quote Link to comment
pontevecchio Posted September 13, 2019 Report Share Posted September 13, 2019 It would be possible to find a new H1 sponsor to file a non cap petition for you, assuming the I-140 was not revoked in the past. In fact approach your I-140 sponsor and tell him you want to come back in H1 status. Quote Link to comment

My I140 is now withdrawn by my old employer after 2 years of its approval. Still am I eligible h1b cap exempt based I140 approval? Quote Link to comment
