Shweta Dixit Posted September 9, 2019 Report Share Posted September 9, 2019 Hello My husbands I-140 was approved but unfortunately he changed his employer within 4 months of approval - and his x-employer has revoked his I-140. Now he has been denied from his new job because they are not willing to file new I-140 - though his H1b visa extension is valid till 2021 (but he has been laid off from a new employer) - what are our options and chances to stay in united states ? I , am currently on H4 (NO EAD) but has 3 years valid for my H1b sponsorship. Whose case is stronger here ? OR we have no option but to leave the country ? Quote Link to comment

User099 Posted September 11, 2019 Report Share Posted September 11, 2019 You will have 60 days from the day he was layed off to find a new Job. If he can find anything in those 60 days, they can apply for his H1B transfer and you will be in status. If he cant find anything in 60 days and you have a job offer, he can convert to H4 and you can move to H1B. Quote Link to comment

Shweta Dixit Posted October 9, 2019 Author Report Share Posted October 9, 2019 on the same topic - we have few more days left for our 60days grace period , but in the meantime I foresee an job opportunity but it might take some time for all the documentation to complete - Do we go out of a status if all documentation gets completed after our 60 day grace period ?
