Traws
Hi , I have applied for h1B in 2015 via employer A. Transferred to employer B in 2016 and been with same employer B and client till date. Came for 2nd Visa stamping with employer B. Visa officer issued 221g whiteslip and no documents where asked. Recently while checking case status in USCIS case status tracker, I found my initial petition status is showing as NOIR and it was issued on june 2019.Rest all petitions showing as approved which are filed by employer B. I have no proper contact with my employer A. Not sure whether he will respond to my NOIR. below are my questions: 1. Status still showing NOIR, does that mean my petition is not yet Revoked? 2. How long USCIS will take to revoke after NOIR is not addressed ? 3. NOIR issued to my previous employer and has no contact with him from last 3 and half year, can My current employer use this point and talk to USCIS via phone call or US embassy via email? 4. What should i or my employer do now ? 5. Can my employer B file a new h1B extension now? And can I go to stamping if it is approved ? Please advice. Quote Link to comment
gopalakrishnach
Normally when you do not work for any employer it is by law that employer must inform USCIS that you no longer work for them and get H1B revoked. I guess Emp A did that now. Quote Link to comment
Traws
Thanks for the reply. I messaged him asking whether he applied for revocation his answer was NO. That is only time he responded to me. I am currently in India and waiting on 221g response. What can i do now? Quote Link to comment
Traws
Thanks for the reply. I am trying to get in touch of my employer currently. 1.As NOIR issued 75days back and has to be responded in 30days, will it be of any help if he responds now ? 2.what if he withdraw my petition before USCIS revoke my petition ? 3.How do I know case is still in NOIR status or is it revoked ? But USCIS status tracker showing NOIR. I heard tracker is not updated regularly? Quote Link to comment
