I filed 290B a week ago for my 15-year-old son as his 485 was denied due to a notarial birth certificate that was missed. Now I want to refile a 485 in order for my son to remain in H4 status. My 485 is pending, and so is my wife's. An interview was scheduled and then cancelled for three of us. About a week ago we all filed an petition for extending our H1b/H4, which will expire early September. Questions. (1) Is it a good idea to refile 485 with 290B pending? (2) If a new 485 is filed and received, would that allow my son to remain in status while the new 485 is pending? Thanks. Quote Link to comment
