pkushiqiang
Just got the notice, my full time H1B extension is denied. But I had an approved concurrent H1B, I-94 valid to 5/2021. I have some questions: 1. Can I stay is U.S with the concurrent H1B? 2. My full time company will refile a new H1B application, can I go back to work when I just receive the USCIS receipt? If yes, what's the longest time can I work with H1B receipt? 3. My wife's I 94 is expired on 5/11/2019, is she out of status? If yes, could she apply H4 inside U.S., or must leave the U.S. and apply H4 visa from U.S. embassy? Quote Link to comment
pontevecchio
1. Yes 2. Possibly. 3. Possibly not. Discuss your situation with a lawyer. Quote Link to comment
gopalakrishnach
3) She can go to Mexico and get her H4 visa stamped based on your concurrent H1B, I-94 valid to 5/2021 Quote Link to comment
