jawal
I and my spouse are lawful permanent residents. Our toddler child is a US-born US citizen. For personal reasons, we came to India with valid re-entry permits (expiring in December 2019). We have been out of the USA for approximately one and a half years. Now we want to return. We hold some assets in the USA and some property, however, as of now, I or my spouse do not have a job offer. Could someone comment on what questions we could be asked at the customs or issue that we could face? I also read about the new public charge rule that goes into effect in October. Could a lack of job offer (when we return) be used as a basis for denial of entry at the port of entry under the public charge rule? Also, I read some airports are friendlier than others for reentry. Is it true? Thanks Quote Link to comment
pontevecchio
How long have you worked after getting the GC for the sponsor? All Airports are the same. Some are more crowded . Avoid NEWARK AND MIAMI . It may be a good idea to discuss the matter with the firm of Murthy or any of your choice. The public charge rule will not affect you and in any case will be rejected by the courts. Quote Link to comment
jawal
@Pontevecchio, Thanks for your comments. I worked for about a year after we got GC. In total, I had employment between 2007-2018. And with University in the capacity of a Post-doc and scientist in biological sciences for about 6+ years. My research made worldwide news, as well as I hold a US patent in a discovery. Quote Link to comment
pontevecchio
Then I would not expect any problems. You may go to secondary Inspection where the Officer will verify your Re-entry permit and then let you in. Edited August 14, 2019 by pontevecchio Quote Link to comment
