Recommended Posts

Hello
Working on H1B visa and my current company transferred my H1B visa and filed successfully filed AC21 to port my EAD/AP card(for GC).

I have EAD/AP card and I-485 pending for 5 yrs in EB2 Category.
My question are -
1)If I lose my current job so will lose my H1B status immediately. But Can I get another job in same field on my EAD card?
My EAD card is valid for next 2 yrs
2)Approx How much time I can wait in USA to find job on valid EAD card?I mean can I find job in 4-5 months staying on EAD card?

Nothing gets transferred. A new non cap petition is filed and approved. The Visa is an entry foil in your passport.

1Yes

2. You are legally allowed to stay on the basis of the pending AOS. On an EAD you may work or not. You are still legal to stay. Of course if or when USCIS wants to see an EVL appropriate to you, you will need to show it.

1)Does company immigration lawyers inform usics Job termination about Pending AOS/Green card or only H1B termination?

2)Do the RFE for EVL comes for H1B termination or Pending AOS or both?

An H1 sponsor is mandated to revoke the H1 petition of employees who no longer work there. The AOS is not involved except that they may ask for an EVL in the future if they deem it necessary. The bottom line is that you need an appropriate job in the same or similar field in any case.
