sunnygarg
Hi everyone, need guidance from the community regarding this situation. Me and my wife are traveling from USA to Vancouver, Canada for a family visit. I am on H1 and my wife is on H4 visa. I need to get my visa stamping done as well there so I can re-enter US. She will be coming back before me to US as her H4 visa is still valid from her India visit last year. At the port of entry, can there be any issues for her if H1 visa holder (me) is outside the country and waiting for visa stamping? Thanks Sunny Quote Link to comment
pontevecchio
Have you heard of Automatic Visa Revalidation where you use your Current I94 to return? Is your trip less than 30 days? Quote Link to comment
sunnygarg
Hi, thanks for the response. Apologies for replying late, didn't get any alerts when you responded. I am not eligible for automatic visa re-validation as my I-94 has expired. So I do need to go for visa stamping again. Quote Link to comment
sunnygarg
I take that back. My I-94 is valid on my latest I-129. So I might be eligible for AVR. I need to look more into that. Thanks for the tip... Quote Link to comment
pontevecchio
If your I94 has expired, you are in unlawful status now. On what basis are you working now? Quote Link to comment
