I've found a new employer who submitted my H1B petition with premium processing today July 30th 2019. My 60 day grace period on H1B ends on 14th August. My start date with the new employer is 19th August. My H1B visa is valid till 2021. I have the following questions: 1. If i get the approval before 14th August and start with the new employer on 19th August will I be 'out of status' between 14th August to 19th August? Will it be an issue? 2. In case I get an RFE, how long can I stay in the country without accumulating unlawful presence? 3. I have a paystub gap of 1.5 months. My new employer has submitted my last paystub with my relieving letter. Can this cause an RFE or issues with H1B transfer? Thank you Edited July 31, 2019 by tanvi05092019 Quote Link to comment
gopalakrishnach Posted July 31, 2019 Report Share Posted July 31, 2019 Till when is your I94 is valid. I am not an expert and I may be wrong. I guess with in 60 days you need find a new employer and apply for H1B in your case you did it. I am not sure about get it approved but one thing I am sure is that before your I94 expires you need to get H1B approved with new I94. I may be wrong. Quote Link to comment
