H1B End date and I94 end date different on I797A

Hi,

My H1B Extension was approved with the below end dates on I797A.

H1B end date : 12/26/2020

I94 End Date: 01/05/2020

I feel that this is a clear typo as the I94 end date should be H1B end date + 10 days, which makes it 01/05/2021.

I have submitted a SR with USCIS and it still has a couple of more weeks before its SLA.

I have the below questions.

1) Will USCIS send another I797A with corrected I94 end date ?

2) In any case, Can I go to India and get the visa stamped ?

3) When I go for stamping, till when I will get the visa. Would the I94 end date be considered or would H1B end date be considered ?

 

Please advise.

Just go and get visa before 1/5/2020. They will consider the H-1 expiry date. Not the I-94 expiry.

Hi, I am In the same boat

I94 End Date: 01/10/2020.          ( I feel it as typo as it should be 1/10/2021)

I realized it today after 90 days of the I94 end date. Please let us know if your SR with USCIS  was approved. or What did you do exactly to resolve the issue. I cannot go out of the country now due to COVID 19.

Please update the thread, I am in the Same situation and worried cannot go out of Country due to COVID19
