I plan to travel outside US to get H1B stamped for the first time but she is not travelling. What will be her status when I re enter US on H1B ? if she is still considered F2, will she face issues during her H4 visa interview later on ? Quote Link to comment

gopalakrishnach Posted July 10, 2019 Report Share Posted July 10, 2019 Once you H1B starts then she cannot be in F2 since your status changed. She must have petition for COS H4 and get it approved or else travel with you and come back to USA on H4 visa stamped. I am not an expert just my opinion. Please consult experts.
