How to use 6 years of my H1B?

Recommended Posts

Hi Experts,

Am in L1B visa since Jan 2015 ie 4.5 years. I got my H1B approved last year but I haven't transferred my L1B to H1B yet.

I cam to know that I can go out of USA for 365 days and then get my H1B visa stamped, I would be getting 6 years of my H1B visa. On the other hand, if I transfer from L1B to H1B then I would get only 1.5 years ie the remaining portion of my 6 years considering my stay in L1B visa.

Can you please correct my understanding? My H1B expires on Jan 2021 and am planning to leave USA by this month and stay in India for a year.

Thanks!

You "came to know" wrong.

The clock only resets if you are abroad for at least a year and THEN a new H1 petition in the quota is FILED.

In your case, your H1 would only be for the remainder time.
