However, I need to take an indefinite break to take care of family and would have to resign from the company. I would like to use H4 during this period to travel to US whenever I need to. My current H1B will be valid till May of next year. However, I am eligible to renew for 3 more years. Would I be able to switch to H1B without a lottery if I return and manage to find a job before May next year? Would I be able to switch to H1B without a lottery if I return and manage to find a job after May next year? Would the switch from H4 to H1B be a change of status wherein I do not have to leave the country? How long will the change of status application take? Can I start working with the receipt or the change in status application? I believe related questions have been asked before but I needed some clarity on whether the date my H1B expires matters and details on the process when moving back to H1B. Quote Link to comment
