Bramaresh Posted June 15, 2019 Report Share Posted June 15, 2019 (edited) Can anyone help answer my question: I am on H1 and filed I-485 for AOS based on “Date for Filling” option for me and my dependents. My priority date is now moving very slowly. My son is in studying in college, he is on H4 and 20 years. He would get EAD soon. Question: Assuming the priority date is not current, I-485 is still pending and my son has reached 21 yrs, will he be able to continue his studies based on EAD? pontevecchio Posted June 17, 2019 Report Share Posted June 17, 2019 Once he files for AOS, he will wait for the GC. AOS is not any status but a period of stay authorized by the Attorney General. The EAD has no connection to his studies and in fact, will let him work too. Under these circumstances discuss specifics with a lawyer as any missteps will have consequences. Quote Link to comment
