Kaiju Posted June 6, 2019 Report Share Posted June 6, 2019 Hi, I have received approved i140 immigration petition copy instead of i797 approval notice for i140 when requested with FOIA. I would like to know whether the approved i140 immigration petiton copy is sufficient for applying EAD or do we need i797 approval notice copy for i140, if so, can we raise one more foia request for that? Recko Posted June 6, 2019 Report Share Posted June 6, 2019 Per my understanding, I-797 is what you get for your i-140 case type, I-797A for your I-129 case type. in your received I-140 document, it should show on the top left as I-797 Notice of Action. please correct me if i am wrong. For applying EAD, you would require both the documents and few others as well. Thanks Quote Link to comment
