EB2/EB3 Eligibility

Recommended Posts

I'm currently working as a full-time professional on an H-1B Visa. The position that I'm working on requires a bachelor degree with 3-5 years of experience. I have a US Master's degree and 6 months prior experience before the current role. I'm working in my current role since March 2017.

For EB2 Advanced degree, USCIS states that "The job you apply for must require an advanced degree and you must possess such a degree or its equivalent (a baccalaureate degree plus 5 years progressive work experience in the field)". Since the position that I'm currently working on does not require a Master's degree, am I eligible for an EB-2 Visa?

My other question is, am I eligible for an EB-3 Visa? If yes, which category of EB-3 visa am I eligible for (EB3 Professional)? How can I justify to my firm that I meet the minimum education and experience requirements to apply for an EB-3 Visa? Can I use my Master's degree as an equivalent experience in justifying the minimum qualifications?

Please help me with the information.

Thank you for your time.

In this fact pattern, as the job requirement is a Bachelor's degree with at least 3 years of experience, the job would not meet the definition of EB2. However, it would generally meet the definition of EB3 professional.
