Unfortunately, there are no current demands at the US location where my case was filed and employer is not willing to process stamping and not ready to handover I-797 B form as well. In my current situation, please suggest the options available to work at USA either from current employer or with new employer. Kindly help. Regards, Haribabu Link to comment

gopalakrishnach Posted April 5, 2019 Report Share Posted April 5, 2019 Somehow I feel your employer is doing a favor by not doing your stamping and also not giving you I-797B form since the demand at US location for which your case was applied is no longer available/valid. Even if you go to visa stamping by some mean you will get into trouble. So find new employer do H1B transfer/apply new.. Link to comment

You cannot a H1B transfer without working for the original petitioner. This the Op's first H1B I presume, so he needs to fine a new cap-subject petition next year with a different employer. This H1 is now gone, there is nothing to transfer. Link to comment

Nowadays, unless the person starts working for the original H1 employer (or at least gets the H1 visa) the person is not considered counted for the quota, so a transfer is not possible. As I said earlier, that H1 is gone. Link to comment
