H1B Extension - Upgrade to Premium Processing

Hi, I am working for an American vendor for quite some time (initially with Client A).

Recently, my employer has filed for my extension and amendment with Client B. My H1B and I-94 has expired during this phase.

But the project with Client B was shut down in a couple months due to budget constraints.

I have got a new job with Client C in the same week and my employer filed for amendment with Client C. 

As we have the Premium Processing now, I am asking my employer to upgrade my petition to premium processing. But my employer does not want to do that saying it can result in denial of the petition because USCIS can consider the duration of work with Client B as out of status.

I am sceptical about his reason and would like to know what are the chances of approval / denial in my case.

Only USCIS knows that answer. Apply PP and see that outcome sooner.
