My husband got dui with bac .105 and speeding ticket.they took him into police station had fingure prints and pictures.its his first dui. Will it effect my H1 and his H4 status. Quote Link to comment

They may invalidate his visa and he may have to get a new one when he travels and there may be medical tests involved which may delay the visa by a few days. Please get a good DUI Lawyer and an Immigration Lawyer involved to do damage limitation. Quote Link to comment

Your H1b, No. His visa can be assumed revoked already and he will need to appear at consulate for a new visa stamp along with any medical panel tests consulate orders him to go through. His driving license is revoked we went for hearing. We took the attorney appointment. Do we need to take any immigration step. As we had approved visa as of now. Quote Link to comment

In this case they may prudentially revoke his H4 visa stamp which means he can stay till the current I94 and if he wants to travel, he will need a new H4 visa. Quote Link to comment
