kingkoti Posted March 16, 2019 Report Share Posted March 16, 2019 Hi, I am on the 6th year of my H1B and I have an approved I-140 (180 days passed) from Employer A. I quit employer A and moved back to India in July 2018. I now have a new offer from Employer B. My H1B expires on Aug 30, 2019. (It's been 232 days since I quit Employer A). The plan is, Employer B files for my transfer in Premium processing, I get my stamping and fly to the US. 1) Can Employer B file for my H1B Extention using my I-140 from Employer A without filing any new forms? If no, what is the procedure? 2) Can Employer B file for my Extention with the transfer. As in, Filing Transfer and extension at the same time. 3) Is there anything else I need to be aware of? pontevecchio Posted March 18, 2019 Report Share Posted March 18, 2019 1. Yes. The company Lawyer would file for a non cap H1 petition with proof of approved I-140. 2. A "transfer" is a misnomer and used to refer to employer change while in H1 status and does not apply to you. B would file and get a H1 petition approved and you would come over with the visa.
