I had mixed opinions from different blogs about this so I just want here from Murthy blog as well. My previous employer has withdrawn my I-140 petition even after my stay more than 6 months after I-140 approval. They said it is a company policy. This message is from Oct 2017 I received from attorney : "Your I-140 immigrant petition has been withdrawn" . Questions : 1) Can I re-use my I-140 petition for H1B extension (This H1B is from current employer) from new employer. 2) Can I re-use my I-140 petition for new H1B transfer. 3) Can I re-use my I-140 petition for H4 EAD extension. Please provide valuable inputs. 1- Yes if the i140 was approved for 180 days at least before it was withdrawn. Any employer can file a h1b petition on your behalf any number of times until your PD is current. 2- Yes , see 1 , it should have been approved for 180 days. 3- Yes see 1, it should have been approved for 180 days.
